D. v. Allstate Insurance

Greenblatt Agulnick, P.C. was retained following the denial of a major property damage claim submitted to Allstate. While the elderly client was away visiting family, a boiler malfunction caused water to pour out the radiators in the home uncontrolled. The water continued to escape for weeks after first onset. After the loss was discovered, Allstate denied the claim, alleging that the damage was caused by “seepage” or water that “leaked” over a period of weeks, months or years. Litigation was commenced in the Federal District Court in the Eastern District of New York. Greenblatt Agulnick, P.C. successfully re-created the loss scenario and utilized water records to confirm the manner in which the loss took place. Following limited discovery, the matter settled for approximately $250,000.
